The agreement between you and Komodo Cruises. We've kept it as plain as possible — please read it before booking.

These Terms & Conditions govern your booking and travel with Komodo Cruises, operated by PT Komodo Cruises Indonesia, a company registered in the Republic of Indonesia. By making a booking or using our website, you agree to these Terms. If you don't agree, please don't use our services.

01Agreement

When you book a cruise, private charter, or related service with Komodo Cruises, you enter into a legally binding agreement with us. This agreement consists of these Terms & Conditions, your booking confirmation, and any specific terms that apply to the service you've booked (such as route-specific inclusions).

If you book on behalf of a group, you confirm that every member of your group has agreed to be bound by these Terms and that you are authorized to accept them on their behalf.

02Definitions

In these Terms:

  • "We", "us", "our" means PT Komodo Cruises Indonesia, trading as Komodo Cruises.
  • "You", "your", "Guest" means the person making the booking and any person named on the booking.
  • "Booking" means your confirmed reservation for a cruise, charter, or related service.
  • "Vessel" means the boat assigned to your cruise, as specified in your confirmation.
  • "Cruise" means the itinerary, accommodation, and services provided on board.

03Booking & Payment

A booking is confirmed once we've received your deposit and issued a written confirmation (typically by email).

Deposit & Balance

  • A 30% deposit is required to confirm your booking.
  • The remaining 70% balance is due 30 days before departure.
  • For bookings made within 30 days of departure, full payment is required at the time of booking.

Payment Methods

We accept Visa, Mastercard, American Express, and Indonesian bank transfers (BCA). All payments are processed in USD, EUR, or IDR depending on your selection. Foreign exchange rates, if applicable, are determined by your bank or card issuer.

Late Payment

If the balance is not received by the due date, we reserve the right to treat the booking as cancelled by you and apply the cancellation terms in Section 04.

04Cancellation & Refunds

We understand that plans change. Refunds are issued according to the following tiers, based on the number of days between your cancellation request and your scheduled departure date:

All cancellations must be made in writing to bookings@komodocruises.com. Refunds are processed within 14 business days of confirmation.

05Changes by Operator

Itineraries are subject to change due to weather, sea conditions, operational requirements, or circumstances beyond our control. We may modify the itinerary, route, or vessel at our discretion for the safety and comfort of guests and crew.

If we make a significant change before departure, you may choose to:

  • Accept the modified booking,
  • Rebook to another available trip at no extra cost, or
  • Receive a full refund.

Minor itinerary adjustments made during the cruise (such as skipping a stop due to rough seas) do not entitle guests to a refund.

06Guest Responsibilities

By joining a Komodo Cruises trip, you agree to:

  • Arrive at the departure point on time with valid travel documents, including a passport with at least six months' validity and any required visas.
  • Follow all safety instructions given by the captain and crew.
  • Respect other guests, crew, wildlife, and local communities.
  • Not bring illegal substances, weapons, or hazardous materials on board.
  • Be financially responsible for any damage caused to the vessel, its equipment, or third-party property.

We reserve the right to disembark any guest whose behaviour endangers the safety, comfort, or enjoyment of others, without refund.

07Health & Fitness

Cruising in remote parts of Indonesia involves activities such as snorkeling, swimming, hiking, and boat boarding. You must be in reasonable physical condition to participate.

You must inform us at the time of booking of any medical conditions, allergies, dietary requirements, pregnancies, or disabilities that may affect your participation. Failure to disclose relevant information may affect the services we can provide and may invalidate any related claim.

Medical evacuation from remote areas can be complex and expensive. We strongly recommend comprehensive travel insurance (see Section 08).

08Travel Insurance

Travel insurance is strongly recommended and is your responsibility. At a minimum, your insurance should cover:

  • Trip cancellation and interruption,
  • Medical treatment and medical evacuation in Indonesia,
  • Loss or damage of personal belongings,
  • Any activities you plan to participate in, including diving if applicable.

09Liability

We take safety seriously and operate in accordance with Indonesian maritime regulations. However, cruising in tropical and remote environments involves inherent risks. By booking with us, you acknowledge and accept these risks.

To the maximum extent permitted by law, our liability for any loss, injury, damage, or delay is limited to the amount you paid for the booking. We are not liable for:

  • Loss or damage caused by circumstances beyond our reasonable control,
  • Indirect, consequential, or punitive losses,
  • Loss or damage to personal belongings, unless caused by our proven negligence,
  • Acts or omissions of third-party suppliers (such as airlines, hotels, and external tour providers).

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for any liability that cannot be limited under Indonesian law.

10Force Majeure

We are not liable for any failure to perform our obligations if that failure is caused by circumstances beyond our reasonable control, including but not limited to: severe weather, natural disasters, volcanic activity, epidemics or pandemics, government action, war, civil unrest, strikes, port closures, or mechanical failure.

In such cases, we will work with you to rebook your trip or issue a credit, but cash refunds may not be possible depending on the costs already incurred.

11Intellectual Property

All content on our website and in our marketing materials — including text, photography, videos, logos, route maps, and brand assets — is owned by Komodo Cruises or our licensors. You may not reproduce, distribute, or use any of this content without our written permission.

By sharing photos or videos of your trip that mention or tag us, you grant us a non-exclusive, royalty-free license to use that content for marketing purposes, with attribution where possible.

12Data & Privacy

We collect and process personal data in accordance with our Privacy Policy and Indonesian Law No. 27 of 2022 on Personal Data Protection (UU PDP). By booking with us, you consent to the collection and use of your personal data as described in the Privacy Policy.

13Governing Law

These Terms are governed by the laws of the Republic of Indonesia. Any dispute arising out of or in connection with your booking or these Terms will be resolved as follows:

  1. Direct resolution — we will first attempt to resolve the matter with you directly, in good faith.
  2. Mediation — if direct resolution fails, both parties agree to attempt mediation before pursuing any further action.
  3. Arbitration — any unresolved dispute shall be finally settled by arbitration administered by the Indonesian National Board of Arbitration (BANI) in Jakarta, in accordance with its rules.

14Changes to Terms

We may update these Terms from time to time. The most recent version will always be available on our website, with the "Last updated" date shown at the top of this page.

For bookings already confirmed, the version of the Terms that applied at the time of your booking will remain in effect unless you explicitly agree to new Terms in writing.
